Four have case dismissed in Knox County

Four people set to be arraigned Friday in Knox County Circuit Court for second-degree assault had their case dismissed.

Charlotte Davis, AKA Charlotte Asher, 23, Barbourville; Kevin Fuston, 21, of Richmond and a similar address to Davis in Barbourville; and Sabrina Oldrieve, 25, and Neil Oldrieve, 32, both of the same Barbourville address, were all four named on a one-count indictment in July charging second-degree assault after allegedly beating on Teresa Smith and causing serious physical injury on July 12.

It was learned in court Friday that after the four had been indicted, several attempts were made to reach Smith.

Commonwealth’s Attorney Danny Evans motioned to dismiss the case, and Judge Gregory Lay sustained the motion, dismissing their case without prejudice.
